Construction is a critical field big business in Arizona. Many areas of the state seem to be in a constant state of development, and new projects are changing the landscape from the Phoenix Metropolitan Area to tribal lands across the statejust south of the Utah border. Our lawyers represent clients in construction litigation throughout Arizona, and we provide representation for all types of construction-related contracting and transactions as well.

About Our Construction Litigation Practice

Our construction litigation practice encompasses all types of disputes arising at all stages of the construction process. We represent property owners, developers, architecture and engineering firms, contractors and subcontractors, sureties, financial institutions and other clients. We also represent tribes in construction-related dispute resolution, and several of our lawyers have particular experience handling matters governed by tribal Indian law.

Examples of the types of construction disputes we handle include:

  • Breach-of-contract claims
  • Construction defect claims
  • Employment law claims
  • Indemnification claims
  • Insurance coverage claims
  • Personal injury and wrongful death claims
  • Surety claims
  • Warranty claims

Our lawyers represent clients in litigation in Arizona’s state and federal courts. We also represent clients in arbitration, mediation, and informal dispute resolution efforts. In all cases, we carefully assess the circumstances involved in order to provide custom-tailored advice and representation focused on helping our clients achieve favorable results as efficiently and cost-effectively as possible. This is true whether the dispute involves a private residence or a large-scale multi-use development project.

When disputes arise during the construction process, it will often be in all parties’ best interests to find an amicable solution. Doing so can avoid both unnecessary costs and unnecessary delays. Our lawyers understand the practicalities of dealing with construction-related disputes; and, when warranted, we work to negotiate resolutions on behalf of our clients that keep all parties on the job site and out of the courtroom.

About Our Construction Transactions Practice

Within our transactional practice, we advise clients regarding all types of construction-related agreements. This includes everything from construction financing agreements and development contracts to agreements between contractors, subcontractors, insurance companies and other entities. When representing clients in construction contract negotiations, we take a pragmatic approach focused on protecting our clients’ interests without threatening their business relationships or their project deadlines.

We also assist our construction clients with drafting standard contracts, forms, policies and other documents to use within their day-to-day operations. We are able to assist with employment and other business-related legal matters as well. For many of our construction clients, we serve as outside general counsel, working with them to proactively manage their risk and resolve issues before they lead to contentious disputes.
