Arizona Supreme Court affirms in part the holding of the Arizona Court of Appeals Division One that a telecommunications company’s federal and state tariffs limit liability to non-customers.

The Arizona Supreme Court granted review of an opinion issued by the Court of Appeals on 10/1/15, which was previously summarized here.

Upon considering the briefing and oral argument, the Court affirmed that portion of the opinion on which it had granted review per curiam.  The Supreme Court depublished the part of the Court of Appeals’ opinion that held that Arizona’s Blue Stake Law implied a duty of care from public utilities to non-customers.
